Independent Contractors After California’s New Law: Where do we go from here?

The status of management consultants as independent contractors in Jennifer KomskyCalifornia after adoption of the new state law, AB 5, will be the subject of a presentation by employment law attorney Jennifer Raphael Komsky at the IMC SoCal meeting on Friday, March 6.

Komsky will discuss where independent contractors go now following the adoption of AB 5 and the California Supreme Court’s very broad definition of "employee" in the Dynamex Operations West Inc. v. Superior Court case. Under this new test, a worker is considered to be an independent contractor only if all three of the following factors are present:

  • The worker must be free from the control and direction of the payor in connection with the performance of the work, both under the contract and in fact;
  • The worker must perform work that is outside the usual course of the payor’s business; and
  • The worker must be customarily engaged in an independently established trade, occupation, or business of the same nature as the work performed by the worker for the payor.

Jennifer Raphael Komsky is an employment law specialist, representing employers in all phases of litigation before State and Federal Courts as well as administrative agencies, including the Division of Labor Standards Enforcement, the Department of Fair Employment and Housing and the Equal Employment Opportunity Commission.

Komsky advises human resource professionals and business owners, providing ongoing counseling and guidance on company policies and personnel matters. She also conducts workplace investigations and provides training to individuals and large groups in areas of sexual harassment, discrimination, retaliation, employee classification, disability accommodation, and wage and hour compliance.
